Terms of Service

Please read these Terms of Service carefully before using Oryendata. By creating an account or using the platform, you agree to be bound by these terms.

1. About Oryendata

Oryendata ("we," "us," "our") provides an AI-powered media analysis platform for academic researchers at oryendata.com. We are currently operating in a testing period prior to formal incorporation in New Zealand.

2. Eligibility

You must be at least 16 years old to use Oryendata. By creating an account, you confirm that the information you provide is accurate and that you have the authority to agree to these terms.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@oryendata.com if you suspect unauthorised access to your account.

You may not share your account with others or create accounts on behalf of third parties without our written permission. Lab and Institutional plans include multiple seats for authorised team members.

4. Acceptable Use

You may use Oryendata for legitimate academic research, journalism, policy analysis, and related professional purposes.

You may not use Oryendata to:

  • Violate any applicable law or regulation
  • Reproduce or redistribute raw article content in bulk beyond what is permitted by the original publishers' terms
  • Attempt to reverse-engineer, scrape, or extract data from the platform outside of provided export features
  • Circumvent rate limits, access controls, or subscription restrictions
  • Use analysis outputs to harass, defame, or harm individuals or organisations
  • Resell or sublicense access to the platform without our written consent
  • Use automated tools to access the platform beyond what is expressly permitted

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

5. Data Sources and Content

News articles are sourced through NewsAPI.ai (Event Registry), operated by DataScouting d.o.o., under a commercial licence. NewsAPI.ai retains all rights to its API infrastructure, proprietary metadata structures, source ranking systems, and data organisation methodologies.

Original article content displayed in Oryendata remains the intellectual property of the respective publishers. Oryendata does not claim ownership of source article content.

AI-generated analysis outputs, including but not limited to sentiment scores, emotion classifications, framing analysis, theme extraction, reasoning, evidence summaries, and codebook results, are generated by Oryendata's proprietary pipeline and are owned by Oryendata. These outputs are licensed to you for use in your own research under the terms of your subscription.

6. Intellectual Property

Oryendata's platform, including its design, code, framing frameworks, methodology documentation, and analysis pipeline, is our intellectual property. Nothing in these terms transfers ownership of our platform to you.

You retain ownership of any research, publications, or derivative works you create using Oryendata's analysis outputs. We ask that academic publications using Oryendata cite the platform in their methodology section.

7. Subscription and Payment

During the current testing period, Oryendata is available free of charge. Paid plans will be introduced at public launch.

When paid plans launch:

  • Subscriptions are billed monthly or annually in advance
  • All prices are in USD unless otherwise stated
  • Payments are processed by Stripe
  • Subscriptions renew automatically unless cancelled before the renewal date
  • We do not offer refunds for partial months, except where required by applicable law

We reserve the right to change pricing with 30 days written notice to existing subscribers. Price changes do not apply to the current billing period.

8. Availability and Limitations

We aim to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.

Analysis results are generated by AI and are provided for research assistance purposes. They should be reviewed by the researcher before inclusion in published work. We do not warrant that analysis outputs are error-free or suitable for any specific research purpose.

Article availability depends on our data source providers. We cannot guarantee availability of specific publications or historical date ranges.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Oryendata is provided "as is" without warranties of any kind, express or implied.

We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or reputational harm, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of Oryendata shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under New Zealand law.

10. Indemnification

You agree to indemnify and hold harmless Oryendata and its founders, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these terms
  • Your use of the platform in breach of applicable law
  • Any content or research you produce using Oryendata's outputs

11. Termination

You may close your account at any time by emailing support@oryendata.com. We will delete your data within 30 days of account closure.

We may suspend or terminate your access immediately if you breach these terms, if required by law, or if we reasonably believe your use poses a risk to the platform or other users. In such cases we will notify you unless prohibited by law.

12. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

If you are based in the European Union, you retain any rights granted to you under applicable EU consumer protection law that cannot be waived by contract.

13. Changes to These Terms

We may update these terms as the platform develops. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
